Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and Obelisk Aerospace LLC (“Obelisk,” “we,” “us,” or “our”) governing your access to and use of the Obelisk mobile applications, this website at obeliskaerospace.com, and any related services, features, and content (together, the “Service”). Please read them carefully. By creating an account, purchasing a subscription, or otherwise accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

1. Safety — read this first

Obelisk is a supplemental situational-awareness aid, not a certified aviation instrument or a source of official air-traffic-control instructions. It is not a navigation system and is not approved by the Federal Aviation Administration or any other aviation authority for use in the operation of an aircraft.

  • Transcriptions, callsign associations, traffic, chart links, and every other output are generated by machine-learning systems and third-party data, and may be inaccurate, delayed, incomplete, or missing. Radio audio may be stepped on, garbled, or dropped.
  • You must always rely on the actual radio transmission, your certificated instruments, official charts and publications, and your own training and judgment. Never use Obelisk as a primary source for any clearance, instruction, frequency, altitude, heading, or safety-of-flight decision.
  • The pilot in command is solely responsible for the safe operation of the aircraft and for compliance with all applicable regulations, including the U.S. Federal Aviation Regulations (14 C.F.R.) and equivalent rules in other jurisdictions. Do not let the Service distract you from flying the aircraft.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service you represent that you meet these requirements and that the information you provide is accurate and complete. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

3. Accounts

Some features require an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Provide accurate information, keep it current, and notify us promptly at team@obeliskaerospace.com if you suspect any unauthorized use. We may suspend or terminate accounts that contain false information or that are used in violation of these Terms.

4. Subscriptions, free trial, and billing

Obelisk Pro is offered as an auto-renewing subscription. By starting a subscription you authorize us and our payment processor to charge your payment method on the terms below.

  • Free trial. New subscribers may receive a 30-day free trial. If you do not cancel before the trial ends, your subscription automatically converts to a paid plan and your payment method is charged $20/ month.
  • Auto-renewal. Subscriptions renew automatically at the then-current price each billing period until cancelled. You authorize recurring charges without further action by you.
  • Cancellation. You may cancel at any time from your account settings. Cancellation stops future renewals; your access continues through the end of the period you have already paid for. Except where required by law, partial periods are not refunded.
  • Price changes. We may change subscription prices or the features included in a plan. We will give you advance notice, and changes take effect at your next renewal. Continuing to use a paid plan after a price change takes effect constitutes acceptance of the new price.
  • Payment processing & taxes. Web payments are processed by Stripe and are subject to Stripe’s terms; we do not store full card numbers. You are responsible for any applicable taxes. If a subscription is instead purchased through Apple’s App Store, that transaction is governed by Apple’s terms and managed through your Apple account.
  • Failed payments & chargebacks. If a charge fails or is reversed, we may suspend or terminate your access until the balance is resolved.

5. License and ownership

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the Obelisk app on devices you own or control, and to use the Service, for your own non-commercial aviation use. We and our licensors retain all right, title, and interest in and to the Service, including all software, models, text, graphics, and the Obelisk name and logo. No rights are granted except as expressly stated here.

6. Acceptable use

You agree not to, and not to permit anyone else to:

  • use the Service in violation of any law or of the terms of any audio, traffic, or chart source you connect (for example, LiveATC.net’s terms of use);
  • copy, modify, reverse-engineer, decompile, or attempt to extract the source code or models of the Service, except to the extent this restriction is prohibited by applicable law;
  • resell, sublicense, rent, or commercially exploit the Service, or share your account or subscription with others;
  • interfere with or disrupt the Service, probe or breach its security, or access it through automated means or scraping without our permission; or
  • use the Service to build a competing product or to train competing models.

7. Third-party data and services

The Service relies on data and services provided by third parties, including live radio streams (such as LiveATC), ADS-B traffic feeds, publicly available FAA aeronautical charts and data, Apple, and Stripe. We do not control and are not responsible for the accuracy, availability, or practices of these third parties, and their content is provided subject to their own terms. You are responsible for complying with the terms of any source you connect to the Service.

8. Your content

You retain ownership of information you enter, such as flight plans and settings. You grant us a limited license to process that information solely to provide and improve the Service. As described in our Privacy Policy, audio capture, transcription, and correction are designed to run on your device.

9. Beta and pre-release features

The Service, including any TestFlight or beta release and any feature we describe as planned or “on the roadmap,” may be incomplete, may change or be withdrawn at any time, and is provided without any service-level commitment. We make no promise that any particular feature will be released or will function as described.

10. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY AS TO ACCURACY, COMPLETENESS, RELIABILITY, OR AVAILABILITY. WE DO NOT WARRANT THAT THE SERVICE WILL BE ACCURATE, UNINTERRUPTED, ERROR-FREE, OR SUITABLE FOR ANY FLIGHT-RELATED PURPOSE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OBELISK AEROSPACE LLC AND ITS OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR FOR ANY DAMAGES ARISING FROM FLIGHT-RELATED OR OPERATIONAL DECISIONS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS. THESE LIMITATIONS ARE A FUNDAMENTAL PART OF THIS AGREEMENT.

12. Indemnification

You agree to indemnify and hold Obelisk Aerospace LLC harmless from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. Provisions that by their nature should survive termination — including ownership, disclaimers, limitations of liability, and indemnification — will survive.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States of America, without regard to its conflict-of-laws rules. Before filing a claim, you agree to first contact us at team@obeliskaerospace.com and attempt in good faith to resolve the dispute informally. Any dispute that cannot be resolved will be subject to the exclusive jurisdiction of the courts located in that jurisdiction, unless applicable law requires otherwise.

16. Miscellaneous

These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control.
